Orbital Blackout is a free-to-play browser space game operated by Theodore Armando Gutierrez, trading as Orbital Blackout ("we", "us"). By creating an account or continuing to use the game, you agree to these terms and enter into an agreement with us. If you do not agree, do not use the service.
Eligibility and your account
- You must be of legal age to enter a contract in your country, or have permission from a parent or guardian. If you accept on behalf of an organisation, you confirm you have authority to bind it.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must provide accurate information and keep it up to date.
Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to play Orbital Blackout for personal, non-commercial use. You may not reverse engineer the game, resell or redistribute access, or circumvent technical limits.
Acceptable use
- No unlawful use of the service.
- No fraud, chargebacks in bad faith, spam, or harassment of other pilots.
- No infringement of anyone's intellectual property.
- No interference with the security of the service — no malware, probing, scraping, automated clients, bots, exploits or cheating tools.
Intellectual property
We retain ownership of the game and all of its intellectual property, including the software, artwork, ship designs, hull paints, branding and documentation. In-game items, currencies, ships and cosmetics are a licence to use features within the game; they are not your property and have no cash value outside the game.
User content
Where you submit content such as a callsign or support message, you grant us a limited licence to host and process it solely to operate the service. You must have the rights to anything you submit.
Purchases and payment terms
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our own Refund Policy explains the 30-day money-back guarantee. Prices are shown in real currency on the pricing page; there is no premium currency, no loot boxes, and nothing sold affects combat power.
Service level and changes
We do not guarantee that the service will be uninterrupted, error-free or permanently available. As a live game, we may balance, change, add or remove features, including adjusting the effect of boosters or the appearance of cosmetics, to keep the game fair.
Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages including lost profits, lost data or lost in-game progress. Our aggregate liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow exclusion.
Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
Suspension and termination
- We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations such as cheating.
- You may stop using the service and request account deletion at any time.
- On termination, access to the game and to purchased items ends. You may request an export of your account data before deletion.
General
These terms are governed by the laws of the State of California, United States, and disputes will be heard by the courts of that jurisdiction. You may not assign your rights without our consent; we may assign ours in connection with a merger or sale. Neither party is liable for failures caused by events beyond reasonable control.
